These Terms and Conditions ("Terms") govern your access to and use of the Sylvie Plant App mobile application and our website (together, the "Service"). By using the Service, you agree to these Terms.

Eligibility

You must be at least 13 years old to use the Service.

Accounts and Sign in with Apple

  • Sign in: The Service may use Sign in with Apple to create and authenticate your account.
  • Account security: You are responsible for maintaining the confidentiality of your device and any authentication credentials.
  • Account deletion: You can delete your account from within the app. Deleting your account removes app data as described in the Privacy Policy.

Subscriptions and purchases (Sylvie Premium)

Sylvie may offer auto-renewable subscriptions ("Sylvie Premium") through Apple In-App Purchase.

  • Billing: Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Renewal charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Manage or cancel: You can manage or cancel your subscription in your Apple ID account settings in the App Store.
  • Restore purchases: If supported, you can restore purchases using the in-app "Restore Purchases" option.
  • Refunds: Refund requests are handled by Apple under Apple's policies.

Plant identification and AI features

  • Identification: Plant identification results are provided for informational purposes and may be incorrect. You are responsible for verifying plant identity, especially before consuming or handling plants.
  • Care tips and AI content: Tips, enrichment, and fun facts may be generated using AI and may be incomplete, outdated, or incorrect. They are not professional horticultural, medical, or safety advice.
  • Toxicity and safety: Do not rely solely on the Service to determine whether a plant is safe for children, pets, or consumption.

Care reminders and notifications

The Service may provide local and/or push notifications for care reminders if you enable them. Notification timing is not guaranteed and may be affected by device settings, network conditions, and operating system behavior.

Your content

You may provide content such as plant photos, notes, plant names, and other information ("User Content").

  • Ownership: You retain ownership of your User Content.
  • License to operate the Service: You grant us a limited, non-exclusive, worldwide license to host, store, process, and transmit your User Content solely to provide and improve the Service (for example, syncing across devices, generating tips, and displaying your plant library).

Acceptable use

You agree not to:

  • misuse the Service or interfere with its normal operation
  • attempt to access the Service using automated means intended to abuse rate limits or systems
  • reverse engineer, decompile, or attempt to extract source code from the Service except where permitted by law
  • use the Service to violate any applicable law or third-party rights

Intellectual property

The Service, including its design, text, graphics, and software, is owned by K. Quinones or licensors and is protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred.

Third-party services

The Service may rely on third-party services (for example Apple services, plant identification providers, and AI providers). Your use of those services may be subject to their own terms and policies, and we are not responsible for third-party services.

Privacy

Your use of the Service is also governed by our Privacy Policy, available on our website.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, K. Quinones will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising from or related to your use of the Service.

Termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms or if needed to protect the Service, users, or third parties. You may stop using the Service at any time, and you can delete your account from within the app.

Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of the Service after changes become effective means you accept the updated Terms.
